On April 12^th, 2021, Florida-based marketing agency Creative Klick Agency LLC (“Creative Klick”) filed a copyright infringement suit in the U.S. District Court for the Southern District of Florida against social media celebrity Dan Bilzerian and his beverage company, Ignite Spirits Inc. (“Ignite”) The lawsuit follows a major social media marketing blast by Bilzerian and Ignite to promote a new vodka product.

After choosing to hire a different marketing agency, Bilzerian, Ignite, and its affiliates posted sample marketing photos owned by Creative Klick on various social media accounts belonging to Bilzerian without the agency’s permission. The mentioned photos were samples sent to Ignite during negotiations with Creative Klick to provide social media marketing material, including high-end photography for the beverage company.

Ignite’s Instagram account has more than 3 million followers, and Bilzerian’s account has more than 32 million followers. With over 35 million followers combined, Creative Klick claims that sharing these sample photos allowed the defendants to profit directly from using the agency’s copyrighted photographs.
